& Studio Policy of Atelier Māya

Atelier Māya workshops, research intensives and in-person experiences are one-on-one or small-group offerings with limited availability. Considerable research, correspondence, sourcing, testing, programme development and studio preparation may begin well before an experience takes place. This policy applies to all public workshops, private workshops, group bookings, talks, community sessions, guest workshops, studio events, research intensives and independent studio access booked directly with Atelier Māya, unless separate written terms have been expressly agreed.

1. Booking & Acceptance

A booking becomes binding once the required payment or deposit has been received and Atelier Māya has issued written confirmation. The service description, proposal, booking confirmation, invoice, any individual written terms and this policy together form the agreement. Where separate written terms have been agreed for a booking, those terms take precedence over this policy to the extent of any inconsistency. The version of this policy provided at the time of booking applies to that booking.

2. Cancellations

Public Workshops & Fixed-Date Events

Cancellations made more than seven days before the scheduled date are eligible for a full refund or, on request, a workshop credit. Cancellations within seven days, and non-attendance, are non-refundable and cannot be rescheduled. As these are date- or period-specific leisure services, the statutory right of withdrawal for certain distance contracts does not generally apply. Any credit issued is subject to availability, is usable only for an eligible Atelier Māya offering, has no cash value, and must be used within the stated period.

Private Workshops, Research Intensives & Bespoke Bookings

The payment, cancellation and rescheduling terms in the individual proposal, invoice or confirmation apply. Unless otherwise agreed in writing: the deposit is non-refundable and secures the dates while allowing research and preparation to begin; the balance is due by the stated date, and non-payment may result in cancellation; reduced participant numbers do not reduce the agreed fee; and dates, services and places may not be transferred without written permission. Changes to date, duration, numbers, content or scope are subject to availability, written approval, and may incur additional fees.

Research, Development & Preparation

Preparation for private and bespoke bookings, including consultations, research, curriculum development, sourcing, sample and material preparation, testing, and studio reservation, is earned as it is performed and is non-refundable once begun. Cancelling the future in-person portion of a booking does not make already-completed work refundable. Materials ordered, supplier commitments, commissioned work and other non-recoverable costs are likewise non-refundable. Where part of a service remains unperformed, any legally refundable amount is assessed after deducting the non-refundable deposit, work already completed, reserved capacity, committed materials, third-party costs, and any other amount Atelier Māya is legally entitled to retain.

3. Nature of the Relationship

Atelier Māya workshops and research intensives are educational, research-led, practice-based services provided within the scope stated in the booking. Unless separately agreed in writing, a booking is not a commercial collaboration, commission, consultancy, residency, partnership, employment relationship, co-authorship arrangement, or an agreement to develop, represent or commercialise the participant's work. A participant purchases only the described educational experience and acquires no entitlement to continuing direction, production assistance, representation or support once the booked service ends.

A participant may not unilaterally redefine a booking into a collaboration or commission, introduce new deliverables, impose new IP, licensing, confidentiality or co-authorship conditions, or require Atelier Māya to transfer or waive rights. Any amendment takes effect only when Atelier Māya expressly accepts it in writing; submitting proposed terms does not itself constitute acceptance, and Atelier Māya may reject terms that conflict with or expand the confirmed booking.

Termination for Material Cause

Atelier Māya may terminate a booking where a participant's conduct or proposed terms fundamentally alter the relationship, undermine the trust the service depends on, threaten or attempt to appropriate Atelier Māya's intellectual property, amount to material breach, or raise serious legal, ethical or safety concerns. Where reasonable, the participant will first be given a chance to correct the issue; no such opportunity is required where the matter is serious enough that trust cannot be restored. Following termination for material cause, Atelier Māya remains entitled to payment for all work performed and costs incurred, and may retain and apply any deposit against these amounts, returning any legally refundable balance and invoicing any shortfall.

4. Independent Studio Access

Independent studio access means use of the agreed space, facilities and equipment without continuous teaching, supervision or creative direction, limited to what is expressly included in the booking. Participants must attend only at agreed times, follow safety and equipment instructions, use only approved materials, seek permission before using unfamiliar equipment, respect others' work and private areas, and leave the space in the agreed condition. Access is personal to the named participant and may not be shared or transferred without written permission.

5. Travel & Personal Circumstances

Participants are responsible for their own travel. Transport disruption, illness, visa issues, weather and similar circumstances do not automatically entitle a participant to a refund, transfer or rescheduling outside the standard cancellation terms, and non-attendance for these reasons is treated as a participant cancellation. Atelier Māya may, at its discretion, offer an alternative date, credit or substitute participant, but is not obliged to and is not responsible for travel, accommodation or visa costs. Travel and cancellation insurance is strongly recommended.

6. Cancellation by Atelier Māya

Where Atelier Māya cancels because it cannot provide the agreed service, the participant receives a full refund for the cancelled portion, with an alternative date or credit offered where practicable (though not mandatory to accept). This does not apply where Atelier Māya instead terminates for material cause (Section 3), in which case that section governs. Atelier Māya is not responsible for participants' additional costs, such as travel or accommodation, except where liability cannot legally be excluded.

7. Atelier Māya's Intellectual Property

Booking, paying for, or participating in a workshop, private session, research-intensive or studio-access period does not transfer any ownership in Atelier Māya's intellectual property. Atelier Māya retains all rights, in every jurisdiction, in its original work (“Atelier Māya Materials”), including written and visual teaching materials, manuals and handouts, programme and curriculum structures, original texts, presentations, research compilations, photographs, films and audio, original textile, surface, print and block designs, colour systems and technical documentation, samples, prototypes, research archives, and other independently developed creative or educational work.

Participants may apply general skills and knowledge gained in their own practice. Participation does not grant permission to copy, publish, sell, distribute, or teach from Atelier Māya Materials, to reproduce the structure of a workshop as a teaching programme, to record or reproduce demonstrations for publication or commercial use, or to present Atelier Māya Materials, in whole or adapted form, as the participant's own original work or research.

Warranty Against False Claims of Authorship

  • By booking, each participant represents and warrants that they will not, at any time:

  • claim or represent authorship, origination or ownership of any Atelier Māya Material;

  • file, or assist a third party in filing, any copyright, trademark, design, patent or other intellectual-property registration or application based on, derived from, or substantially similar to any Atelier Māya Material;

  • present Atelier Māya Materials, in whole or in adapted form, to a gallery, publisher, employer, platform, client or the public as the participant's own creative or research output;

  • assert to any third party, including a marketplace, publication, funding body or court rights in Atelier Māya Materials that conflict with Atelier Māya's ownership; or

  • remove, obscure, or fail to preserve any attribution or provenance marking Atelier Māya applies to its materials.

Evidence of Authorship & Provenance

Atelier Māya maintains dated records of its research, designs, drafts, samples and documentation as evidence of authorship and creation date, and may rely on and disclose such records to platforms, courts or authorities to establish provenance in the event of a dispute.

Remedies for False Claims

Where a participant, or a third party acting with a participant's knowledge or materials, claims authorship or ownership of Atelier Māya Materials, or seeks to register, publish, sell, license or otherwise exploit them without permission, Atelier Māya may, without prejudice to any other remedy available at law:

  • demand immediate cessation of the conflicting claim or use;

  • require a written corrective statement or retraction, including to any platform, publisher or third party involved;

  • issue takedown notices to any platform, marketplace or publication where the material or claim appears;

  • seek injunctive relief and damages; and

  • recover its reasonable legal and administrative costs from the participant responsible.

A participant who breaches this section indemnifies Atelier Māya against claims, losses, costs and expenses (including reasonable legal fees) arising from the breach. This section survives the end of a booking indefinitely, regardless of how long ago the booking took place.

Atelier Māya does not claim exclusive ownership of historic textile traditions, cultural knowledge, facts, or general craft techniques not legally capable of exclusive ownership, its rights relate to its own original expression, designs, documentation, research compilations and teaching materials.

8. Participant Work

Participants generally retain rights in original work they independently create during a booking, subject to Atelier Māya's rights in its pre-existing materials, any separately agreed project terms, and applicable third-party rights and law. Creating work in the studio does not, by itself, make Atelier Māya a co-author, collaborator or commercial partner in that work; equally, a participant does not acquire ownership of Atelier Māya's research, designs or materials merely by encountering or using them during a booking. Any commissioned research, design development or creative-direction work must be separately agreed in writing as to ownership and permitted use.

9. Confidentiality

Participants may encounter confidential or unpublished information belonging to Atelier Māya, another participant, or a collaborator or supplier, including unpublished research, prototypes, designs, formulations, supplier or client details, pricing, and work in progress. Such information may not be photographed, recorded, disclosed, commercially used or published without written permission, unless it was already lawfully public, already lawfully known without a duty of confidentiality, independently developed, or lawfully obtained elsewhere. Access to confidential information is limited to the purpose of the booked service and grants no ownership or continuing right of use.

10. Photography, Filming & Recording

Photography, filming and audio recording are not permitted during workshops or sessions unless prior permission is granted, and permission covering another participant must also be obtained from them. Permission to record does not include permission to publish, use commercially, reproduce teaching content, record a full demonstration, identify another participant, disclose confidential information, or present the material as the participant's own teaching or research. Atelier Māya will seek appropriate permission before using recognisable images of participants for promotional purposes.

11. Materials, Safety & Belongings

Textile processes, natural dyes and handmade materials naturally vary, and Atelier Māya cannot guarantee an identical or predetermined result unless expressly agreed as part of a commissioned service. Participants must disclose relevant allergies or health concerns in advance, follow all safety instructions, and use protective equipment where provided. Participants are responsible for their own belongings; studio materials may permanently stain clothing or personal items, and suitable protective clothing is recommended.

12. Studio Conduct, Exclusion & Damage

Atelier Māya may refuse admission, suspend access, or exclude a participant where reasonably necessary due to disruptive, threatening or discriminatory behaviour, intoxication, safety concerns, unauthorised recording, misuse of materials or confidential information, or conduct placing people or the studio at risk, with an opportunity to correct the conduct first where appropriate. Exclusion may occur without a refund, particularly where preparation or the service has already begun. Individuals formally prohibited from Atelier Māya's premises or activities may not book or attend, and any such booking may be cancelled with payment returned less any amount legally retainable. Participants may be held responsible for loss or damage caused intentionally or negligently to studio property, equipment or others' property; ordinary wear from proper use is not considered damage.

13. Liability

Atelier Māya remains liable without limitation for intentional or grossly negligent conduct, injury to life, body or health caused intentionally or negligently, liability required by mandatory law, and any expressly provided guarantee. For ordinary negligence involving an essential contractual obligation, liability is limited to reasonably foreseeable loss typical of the contract; otherwise, liability for ordinary negligence is excluded to the extent legally permitted. Nothing in this policy limits liability where such a limitation is prohibited by law.

14. Data Protection

Personal data required for a booking, names, contact details, payment and booking information, is processed to administer bookings, communicate with participants, process payments, maintain business records, comply with legal obligations, and establish or defend legal claims. Data may be shared with service providers involved in payment, accounting or technical services, or with authorities where legally required. 15. Acceptance

By completing a booking, participants confirm they have had a reasonable opportunity to read and accept this policy before the agreement is formed. Atelier Māya may update this policy for future bookings; changes do not retrospectively alter an existing confirmed booking unless expressly agreed in writing by both parties.
