This page sets out the standard image licensing terms, usage conditions, and infringement fees applicable to all material within this archive, including photographic works, written content, textile and surface design, visual research, and related creative outputs.

All fees listed reflect standard industry practice and apply unless otherwise agreed in writing. No rights are granted by default.

This Image Licensing & Copyright page sets out the conditions under which works created by Lizane Louw may be licensed, as well as the applicable fees for unauthorised use.
1. Copyright ownership
Unless explicitly stated otherwise, all work on lizanelouw.com and foto-kultur.com is the exclusive intellectual property of Lizane Louw.
This includes, but is not limited to:
Photographic works
Written text
Visual designs
Fine-art and editorial images
Textile and surface design works
Visual research material
All written and visual content developed by the author
All rights are reserved. Copyright is protected under the Berne Convention.
No rights are granted to any visitor or reader beyond private viewing of the content on the Lizane Louw archive websites or the Foto-Kultur webzine/magazine. This also applies to Louw’s creative work on all sites related to Atelier Māya.
All content is the intellectual property of Lizane Louw.
2. Permitted use
No image or work may be used in any form without prior written consent.
Licences that are granted are:
Clear in their description and scope of use
Limited in scope as per the licence
Limited in duration as per the licence
Limited in territory as per the licence
Any use outside the agreed licence constitutes infringement.
3. Prohibited use
The following uses are strictly prohibited without written permission:
Reproduction or redistribution (digital or print)
Use on websites, social media, marketplaces, or platforms
Commercial, editorial, or promotional use
Use in branding, product development, or advertising
Cropping, recolouring, overlaying, or other manipulation
Use as source material for derivative works
Use as source material for AI works
Use for AI training, datasets, machine learning, or generative systems
Scraping, archiving, or dataset compilation
4. Image licensing
Licensing fees are assessed and provided on a case-by-case basis. Assessment considers:
Scope of use of the work
Duration of use
Region and territory of publication or display
Platform where the work will be published
Exclusivity, particularly for fine-art or unpublished designs or projects
Licensing standards are aligned with EU and international industry practices.
Editorial use (online or print):
€250 – €1,200 per image, per publication
Commercial / brand use (digital):
€750 – €7,500 per image, per year
Advertising / campaign use:
€2,500 – €10,000+ per image
Final fees are confirmed in writing prior to licensing and vary by project.
5. Unauthorised use & infringement fees
Any use without prior written permission constitutes copyright infringement.
5.1 Daily infringement rate
For unauthorised use, the following standard infringement fee applies:
€312.50 (three hundred and twelve euros and fifty cents) per image, per day, per platform
This rate reflects:
Industry-accepted licensing standards
Loss of licensing opportunity
Loss of exclusivity and reputational control
Ongoing commercial exposure without consent
The fee applies regardless of whether direct profit was made.
5.2 Cumulative application
Infringement fees apply cumulatively in cases involving:
Multiple images
Multiple platforms
Extended duration of use
Each image, platform, and day is calculated separately.
5.3 Multipliers
Where applicable, infringement fees may be increased using recognised industry multipliers:
Commercial brand or corporate use: up to 3×
AI training, dataset use, or derivative generation: up to 5×
Removal of attribution or false authorship: up to 2×
Deliberate or continued infringement after notice: additional fees
6. Retroactive licensing
Unauthorised use does not entitle the infringing party to a licence.
Any invoice issued following infringement constitutes:
A retroactive usage fee, and
Does not waive further legal claims, including damages, injunctions, or public correction
7. Moral rights
All works are protected by moral rights, including:
The right of attribution
The right to the integrity of the work
Misrepresentation, omission of credit, or false authorship constitutes a violation of moral rights.
8. International protection
All works are protected under international copyright frameworks, including:
The Berne Convention
EU Copyright Directive
Protection applies regardless of the user’s location.

This copyright protection applies in full to all individual projects, collections, publications, workshops, research outputs, digital content, and websites stated above, whether past, present, or future.
Any reproduction, distribution, modification, training of artificial intelligence systems, commercial use, or public display of this material — in whole or in part — without explicit written permission constitutes a violation of copyright law and will be pursued accordingly.
